我们对当今中国公平正义问题的考察，总是习惯于将西方以稳态的现代社会为基准而建构的正义理论作为参照。这种考察方式没有充分考虑转型社会和中国社会转型的双重特殊性。合理的伦理论辩不仅要考察支撑正义原则的社会条件，而且要考察正义原则的历史合理性，而不是仅仅对正义原则进行道德论辩。当今中国社会转型期的公平正义问题，根源于平等价值取向与公平价值取向之间的冲突和张力。这一冲突和张力不可能被消除，只能随着社会的发展而得到缓解，在公平与平等之间达至某种平衡。为此，不仅需要保障公平正义的国家制度的建构，而且需要社会自我救治机制的生长与完善。
