Factors Affecting on Peasants' Legal Behavior: A Positivist Test on Two Classical Paradigms

Abstract

It is one of legality construction contents to make citizen know and obey law. There are two classical paradigms about reasons of people's obedience to law, which are instrumentalist approach and normative approach. The result of survey on Chinese peasants shows that motivations of peasants' legal behavior are neither pure instrumental factors nor pure normative consciousness, but the result of complex factors interplaying on them.
