Abstract

Civil rights are the foundation of state power generating,the state power is an important condition for the realization of civil rights.The balance between civil rights and state power is related to the harmonious social order and the effective maintenance of the public interest.If we see civil rights and state power as two sides of a "balance",the spirit of balance and moral values on the rational spirit are important ways to promote this "balance".The draft law on administrative enforcement,following the path of the legal and moral,plays an important role in balancing the rights and powers of "balance".
