摘要

商业言论是否应得到宪法所赋予的言论自由的保护以及应得到何种程度的保护,对此学术界还存在较大争议。在美国宪法司法的实践中,言论自由原则已经出现向商业领域拓展的趋势,并形成了商业言论原则。虽然言论自由的核心属性是政治自由权利属性,但也具备经济自由权利属性。区分政治性言论与商业言论并在此基础上予以区别对待的做法,不仅会面临言论类型化缺乏可行性的难题,而且还会遭遇经济自由权利崛起的挑战。

Abstract

Scholars have disputed to what extend commercial speech should be protected for a long time. As a trend, the principle of freedom of speech of USA has achieved some developments in the business field. The principle of commercial speech has formed. The article argues that the nature of economical liberties is one of the natures of freedom of speech, although the nature of political liberties is its core nature. To differentiate political speech and commercial speech and give them different treatment may not only bring the dilemma of speech classification lack of feasibility but also meet the challenge of the rising of economical liberties.
