Through analyzing fifteen typical cases of corporate compliance included in three batches released by the Supreme Peoples Procuratorate, this article finds that these cases show the characteristics of diversification in subjects, reasons, and resultsThe reasons for this situation lie in the unclear application prerequisites, unclear division of responsibilities, and insufficient basis for penalty mitigationThe basic cause of this lies in the unclear institutional application of leniency in corporate complianceCorporate compliance should not be used as a criminal policy or a mitigating circumstance of sentencing, but should be integrated into Chinas criminal legal system as a legally prescribed circumstance of sentencingIn terms of substantive amendment, two additional provisions can be added based on Article 31 of the Criminal Law, which explicitly stipulates corporate compliance as legally prescribed circumstances of sentencing for unit crimesFor effective compliance construction carried out before an incident, it should be a legally prescribed circumstance of sentencing as a must; for effective compliance construction carried out in a timely manner after an incident, it should be a legally prescribed circumstance of sentencing as a permissible typeIn terms of procedural design, it is necessary to reasonably define the scope of its application, apply substantive review conditions, separate the incentive of penalty for individuals and enterprises, and ensure voluntary agreement of the involved parties.

There is no solid legitimate basis for criminal compliance, and criminal procedural legislation in this regard should be reconsideredThere is no sufficient study on the actual deterrent effect of criminal compliance and to the actual effect on companies after prosecutionThe pragmatic logic can neither justify the practice of criminal compliance in China nor answer the questions about moral principlesThe legislation about criminal compliance conflicts with the legal system, infringes the basic doctrines of our criminal procedure system, and could lead to the contradiction between Criminal Procedure Law and other laws that regulate corporate governanceMoreover, the operation of procuratorial power during criminal compliance have serious deficiencies, and to confirm it legally is against the direction of the rule of lawDespite the lack of tools such as deferredprosecutionagreements, prosecutors in China could protect companies lawful interests and make a difference for economic development through existing instruments.

During the Eastern Han Dynasty, after Du Du's“Lundu Fu”,there are also other fu rhapsodies on capital cities, for example, Wang Jing's“Jinren Lun”,Fu Yi's“Fandu Fu”and“Luodu Fu”,Cui Yins“Fandu Fu”,Ban Gu's“Liangdu Fu”,and Zhang Heng's “Erjing Fu”Du's fu piece is related to the controversy over whether to move the capital city from Luoyang to Chang'an and can be classified as belonging to the category of “disputing on moving the capital city”,while any of the other works, to the category as “the topic of moving the capital city” because it has nothing to do with the debate on the relocation of the capital cityAppearing as a topic in fu rhapsodies related to the moving of the capital city, the pieces in the latter category show clear signs of textual imitation in structure, content, form, and languageBan Gu's “Liangdu Fu”is included in Fan Ye's Houhan ShuIts inclusion in Xiao Tong's Wen Xuan indicates the shift of its nature from history to literatureThe canonization of the “Liangjing Fu” began with Xiao Tong's incorporation of it into Wen Xuan as the first piece of this genre.

Although the China Institute in America founded in 1926 is not a professional drama association, it is inextricably linked with the development of modern Chinese dramasIt made great contributions to the development of modern Chinese dramas especially around the time of its establishment, precisely during the period between the initiation of “National Opera Movement” in 1924 and Mei Lanfangs visiting the United States in 1930This article tries to present the influence of the China Institute in three aspects: its introduction of the American performance mode to China, its close attention paid to art forms of theatre, and its attempt to build a form of “national drama”that compromises the Chinese classical opera and elements of modern western artsWe may understand the history of modern Chinese drama from a diversified perspective by comparing the differences of Chinese drama before and after the establishment of the China Institute in America.

In Kant's philosophical system, there exists a contradiction between the externality and the unconditional normativity of the duty of right-This contradiction is seen in Kant's view that“the duty of right is indirect ethical duty”The ethical duty is derived from the application of the categorical imperative to the special nature of human beingsDue to the special nature of human beings, the ethical duty can be distinguished from the duty of rightKant further divides the ethical duty into the duty of right which can be externally forced and the duty of virtue which cannot be externally forced because of the characteristics of human's practical activitiesSince the basic principle of right can be derived from the categorical imperative, the duty of right belongs to ethicsFrom the viewpoint that the duty of right can be forced externally, the duty of right is indirect ethical dutyWe should not understand the duty of right as only a means of morality, but as ethical duty that can be externally forcedTherefore, if viewed from the relationship between the duty of right and the ethical duty, it is unconditional; if from the perspective that it can be forced externally, it has externality.

From the practicetypology perspective, the primacy of practice established by Marx inherently contains the question of “what form of practice is primary” and later evolves into the theoretical competition between the primacy of labor and the primacy of other nonlabor's practical formsIn comparing the argumentation strategies of the two, this article finds that the statements on the primacy of labor made by Chinese Marxists neither embraces the KantArendt strategy of hierarchical order, nor does it accept the HegelHabermas strategy of hierarchical evolution, instead, it adopts the interpretive path of historical generation of certain social labor and shows stronger theoretical rationality.
